It?s that time of the year again, and with the launch of Windows 8, Microsoft has brought their dashboard for Xbox 360 in-line with their other offerings.

So, lets look at some of the highlights:

Xbox Music & Xbox Video

The official release of the new Xbox Live Dashboard comes with ?Xbox Music?, the newly re-branded Zune music-service from Microsoft.

?Xbox Video? offers hundreds of thousands of TV shows and movies for buying or renting in instant HD streaming.

The all-in-one music service combines the best aspects of free-streaming radio, music subscription services, and music purchasing options, all in one elegant package, says Yusuf Mehdi, corporate Vice President of Microsoft?s Interactive Entertainment Business Marketing and Strategy. No longer do people have to rely on ?service hopping? to get the music they love.

Refreshed Xbox 360 Dashboard

The dashboard has been updated with more tiles, and a combined TV & Movies channel. To be honest, there?s not too much of a difference, as this had been updated previously to the new style.

Internet Explorer

With Internet Explorer on Xbox, you can easily find and view internet content on the biggest screen in the house, including HTML5 videos.

The new dashboard is pretty difficult to navigate with a controller, but hopefully Kinect motion navigation is only a stones-throw away.

Recommendations and Ratings

Recommendations allow you to discover new content. These recommendations are generated based on a number of variables including the content you previously viewed, what your friends are consuming and what is most relevant and popular within the Xbox community.

Pinning

This feature lets you personalise your dashboard by saving your favorite items onto the home screen. That could be movies, TV shows, games, music, videos or even websites.

Recent

This is a re-branded version of a feature previously called Quick Play. ?Recent? gives you a list of movies, games, apps or other types of content that you most recently accessed on the console.

Enhanced Search

The last Xbox LIVE update brought Bing voice search to Xbox so you could use voice to search for movies, TV shows, actors, directors and artists. This year, genre searching has been added to the list ? so now you can search for action, comedy, romance, drama or sci-fi.

Improved International Voice Search

Kinect voice search capabilities has been expanded to nine new countries ? Canada, France, Germany, Japan, Mexico, Italy, Spain, Austria, and Ireland.

Removal of Facebook & Twitter

According to a Microsoft representative who spoke to IGN, the firm is ?retiring the Facebook and Twitter apps? as it works to streamline functionality.

You can still post updates to either of the apps, but you need to do it via the new Internet Explorer app.

SmartGlass

Microsoft SmartGlass is an updated version of the existing Xbox companion. This time however, it is a companion application which will be available for Windows 8 & Windows Server 2012, Windows Phone, Android & iOS.

So, what are you going to be able to do with SmartGlass? The idea is that your tablet (or phone or computer) becomes an extra display for the content on your Xbox 360. It can for example, provide a cast list for the movie you?re watching, or a display a map in the new Forza Horizon title.

A demo of the functionality within games was provided by Microsoft, showcasing the functionality in the new Madden 13 game.

Exoskeleton of advanced design promises new degree of independence for people with paraplegia

ScienceDaily (Oct. 30, 2012) ? The dream of regaining the ability to stand up and walk has come closer to reality for people paralyzed below the waist who thought they would never take another step.

A team of engineers at Vanderbilt University's Center for Intelligent Mechatronics has developed a powered exoskeleton that enables people with severe spinal cord injuries to stand, walk, sit and climb stairs. Its light weight, compact size and modular design promise to provide users with an unprecedented degree of independence.

The university has several patents pending on the design and Parker Hannifin Corporation -- a global leader in motion and control technologies -- has signed an exclusive licensing agreement to develop a commercial version of the device, which it plans on introducing in 2014.

According to the National Spinal Cord Injury Statistical Center, somewhere between 236,000 to 327,000 people in the U.S. are living with serious spinal cord injuries. About 155,000 have paraplegia. The average age at injury is 41 and the estimated lifetime cost when it happens to a person of 50 ranges from $1.1 million to $2.5 million.

Until recently "wearable robots" were the stuff of science fiction. In the last 10 years, however, advances in robotics, microelectronics, battery and electric motor technologies advanced to the point where it has become practical to develop exoskeletons to aid people with disabilities. In fact, two companies -- Argo Medical Technologies Ltd. in Israel and Ekso Bionics in Berkeley, Calif. -- have developed products of this type and are marketing them in the U.S.

These devices act like an external skeleton. They strap in tightly around the torso. Rigid supports are strapped to the legs and extend from the hip to the knee and from the knee to the foot. The hip and knee joints are driven by computer-controlled electric motors powered by advanced batteries. Patients use the powered apparatus with walkers or forearm crutches to maintain their balance.

"You can think of our exoskeleton as a Segway with legs," said Michael Goldfarb, the H. Fort Flowers Chair in Mechanical Engineering and professor of physical medicine and rehabilitation. "If the person wearing it leans forward, he moves forward. If he leans back and holds that position for a few seconds, he sits down. When he is sitting down, if he leans forward and holds that position for a few seconds, then he stands up."

Goldfarb developed the system with funding from the National Institutes of Health and with the assistance of research engineer Don Truex, graduate students Hugo Quintero, Spencer Murray and Kevin Ha, and Ryan Farris, a former student who now works for Parker Hannifin.

"My kids have started calling me 'Ironman,'" said Brian Shaffer, who was completely paralyzed from the waist down in an automobile accident on Christmas night 2010. He has been testing the Vanderbilt apparatus at the Nashville-area satellite facility of the Shepherd Center. Based in Atlanta, Shepherd Center is one the leading hospitals for spinal cord and brain injury rehabilitation in the U.S. and has provided the Vanderbilt engineers with the clinical feedback they need to develop the device.

"It's unbelievable to stand up again. It takes concentration to use it at first but, once you catch on, it's not that hard: The device does all the work. I don't expect that it will completely replace the wheelchair, but there are some situations, like walking your daughter down the aisle at her wedding or sitting in the bleachers watching your son play football, where it will be priceless," said Shaffer, who has two sons and two daughters.

"This is an extremely exciting new technology," said Clare Hartigan, a physical therapist at Shepherd Center who has worked with the Argo, Ekso and Vanderbilt devices. "All three models get people up and walking, which is fantastic."

According to Hartigan, just getting people out of their wheelchairs and getting their bodies upright regularly can pay major health dividends. People who must rely on a wheelchair to move around can develop serious problems with their urinary, respiratory, cardiovascular and digestive systems, as well as getting osteoporosis, pressure sores, blood clots and other afflictions associated with lack of mobility. The risk for developing these conditions can be reduced considerably by regularly standing, moving and exercising their lower limbs.

The Vanderbilt design has some unique characteristics that have led Hartigan and her colleagues at Shepherd Center to conclude that it has the most promise as a rehabilitative and home device.

None of the exoskeletons have been approved yet for home use. But the Vanderbilt design has some intrinsic advantages. It has a modular design and is lighter and slimmer than the competition. As a result, it can provide its users with an unprecedented degree of independence. Users will be able to transport the compact device on the back of their wheelchair. When they reach a location where they want to walk, they will be able to put on the exoskeleton by themselves without getting out of the wheelchair. When they are done walking, they can sit back down in the same chair and take the device off or keep it on and propel the wheelchair to their next destination.

The Vanderbilt exoskeleton weighs about 27 pounds, nearly half the weight of the other models that weigh around 45 pounds. The other models are also bulkier so most users wearing them cannot fit into a standard-sized wheelchair.

From a rehabilitation perspective the Vanderbilt design also has two potential advantages, Hartigan pointed out:

? The amount of robotic assistance adjusts automatically for users who have some muscle control in their legs. This allows them to use their own muscles while walking. When a user is totally paralyzed, the device does all the work. The other designs provide all the power all of the time.

? It is the only wearable robot that incorporates a proven rehabilitation technology called functional electrical stimulation. FES applies small electrical pulses to paralyzed muscles, causing them to contract and relax. FES can improve strength in the legs of people with incomplete paraplegia. For complete paraplegics, FES can improve circulation, change bone density and reduce muscle atrophy.

There is also the matter of cost. The price tags of other rehabilitation model exoskeletons have been reported to be as high as $140,000 apiece, plus a hefty annual service fee. Parker Hannifin hasn't set a price for the Vanderbilt exoskeleton, but Goldfarb is hopeful that its minimalist design combined with Parker Hannifin's manufacturing capability will translate into a more affordable product. "It would be wonderful if we could get the price down to a level where individuals could afford them and insurance companies would cover them," he said.

Meanwhile, Hartigan has advice for potential users: "These new devices for walking are here and they are getting better and better. However, a person has to be physically fit to use them. They have to keep their weight below 220 pounds, develop adequate upper body strength to use a walker or forearm crutches and maintain flexibility in their shoulder, hip, knee and ankle joints ... which is not that easy when a person has relied on a wheelchair for months or even years."

Japan industrial output falls, unemployment steady

TOKYO (AP) ? Japan's industrial output contracted by 4.1 percent in September from August and 8.1 percent from a year earlier as automakers and steel mills cut production due to shrinking demand and antagonisms with China.

The data released Tuesday by the Ministry of Economy, Trade and Industrial add to pressures on the central bank to stimulate the economy.

The economic recovery that followed Japan's March 2011 disasters has been doused by slowing global growth. Flaring tensions with China over disputed islands in the East China Sea have further crimped demand, especially for big-ticket items like cars. Slowing growth in China, meanwhile, has hit demand for industrial inputs like steel and machinery.

"Industrial production is on a downward trend," the ministry said, forecasting a further decline in October, followed by a rebound in November.

Exports, usually a bright spot for Japan's economy have also been sapped by the prolonged crisis in Europe and the persistent strength of the yen, which makes products made in Japan relatively more expensive in overseas markets.

Shipments of passenger cars dropped 12.6 percent in September from August and 13.2 percent from a year earlier, METI reported. Shipments of virtually all other products also fell.

Jobless rate figures for September likewise offered little encouragement, as the government reported the seasonally adjusted unemployment rate was 4.2 percent in September, unchanged from August.

The ratio of job offers to seekers fell to 0.81 from 0.83 in August, meaning there were 81 jobs for every 100 job seekers.

The central bank was meeting Tuesday, with many expecting it to expand its assets-purchasing program, aimed at catalyzing demand to counter slowing growth.

Family, Parenting, Reviews, and Giveaways - The Attic Girl: Happy ...

Recently my family enjoyed Happy Hauntings at Dutch Wonderland in Lancaster, PA (thanks to US Family Guide).? Dutch Wonderland, a kids' amusement park, turns into a fun spook fest select weekends in October.

We had planned to visit during the summer, but a few things interfered with that, including my gall bladder surgery.? However, we finally were able to carve out some time to go together as a family (which can be tricky since we only have my son every other weekend and we wanted to include him).? It was about a 2 hour drive from my area south of Baltimore.?

I don't know about other moms, but I try to arrive as early as possible when it comes to events that have large crowds.? Due to some traffic, we didn't get there as early as I wanted.? We arrived a little after the park opened at 3:15 and the parking lot was already nearly half full.? My advice:? if you want a shorter walk with a little one, get there early.? Parking is free, so the earlier the better to get a choice parking spot.

Having never been to Dutch Wonderland, I scoped out all the attractions online.? My first objective was to visit the Trick-or-Treat Trail, since I figured that would be a popular spot.

The trail is clearly roped off and has festive stations with costumed helpers that aren't too scary (I think it was a good thing it wasn't dark yet so it was less of a scary factor for little miss).? This was The Attic Baby's first time trick-or-treating, so she wasn't quite sure of how it worked.? She enjoyed walking by herself and trying to say "trick or treat."?? Kids aren't the only ones who get a treat.? Mom and Dad will get a ticket to exchange for a candy too.? If your child has any allergies though, you may want to have an alternative for them (particularly peanut allergies).? We received different kinds of mini chocolate bars, Kit-Kat, and Reece's Peanut Butter cups.

There are many great fall photo opps along the park trails with hay bales, and pumpkins.? And you'll find some-what spooky features along the train ride and monorail.


The monorail had a bit of a line when we arrived, but it went pretty quickly.? We only had to wait a few minutes between trains for the 7 minute ride.? It's a great way to check out all the rides in the park and plot out your ride "strategy."??



Our next priority was a character visit with Duke.? We arrived at the Amphitheater about 20 minutes ahead of the Royal Friends Meet and Greet scheduled time.? Unfortunately, we were informed that Duke had some costume issues, so we had to go back later.?
?
My hubby and the kids had pizza for dinner.? Then we spent quite a bit of time trying to find a place that had something I could eat on my low-fat diet. While there are many places to eat like the Millstream Eatery,? I wasn't able to find a place that wasn't really crowded (there was a long line for the restaurant) and had a lot of low-fat options.? So I just munched on a few snacks.

We went back to the Amphitheater for the next Meet and Greet and were able to see Duke and the Princess.? The Attic baby loved Duke; she kept waving at him and gave him a big kiss when it was her turn on the stage.?




My son enjoyed the slide and the sky ride but chose not to go on the roller coaster after eating (probably a wise decision).???



Once it got dark, the lines started getting longer and The Attic Baby was getting tired.? So we decided to stop by the restrooms before starting the 2 hour drive home.? The restrooms were very clean, had designated stalls for little ones, and hands-free soap dispensers, water faucets and paper towels.

Overall, we really enjoyed our first visit to Dutch Wonderland.? Happy Hauntings was a lot of fun and a great day trip, but I think we will visit again during the regular season.??

The late park hours (they didn't open until 3pm) were a little rough on a young toddler.? And the park at night isn't well lit for navigating with a stroller, especially the parking lot.? If you have to park way out in the other end of the lot away from the castle, it's a dark walk back to your car.? I'd suggest taking glow sticks or a flashlight (we used our cell phone).

How To Choose The Right Realtor Because My Realtor Sucks ...

San Francisco VictoriansFor the right price, everything is for sale. So when my real estate agent friend pitched to put my home on the market this past summer given the lack of inventory, low interest rates, and pent-up demand, I figured why not test things out.

I have a single family home that is suitable for a young internet couple looking to start a family.?I told my realtor that if I don?t get X amount, I?m not selling, and he agreed. The asking price was $100,000 over estimated market value, but he still thought a sale was possible. It?s important to manage his expectations since he?s the one who?s going to be spending all the time staging, marketing, photographing, and showing.

It feels good not having to sell if you don?t get your aspirational price. It?s kind of like going to a bar with your buddies and having no fear talking to the hottest women there because you already have the most beautiful wife already. My biggest goal was to gain enough insight to write this post!

ANNOYING THINGS BY MY REALTOR

* Showed up dirty. ?I was shocked when my realtor strolled up to my house 5 minutes before a private showing in a sweaty shirt, shorts, and sneakers after playing a 1.5 hour tennis match. His appearance was completely inappropriate and disrespectful to the buyers, and to myself. I would never dare go to a meeting that way and am absolutely baffled he would show my house in his getup.

I e-mailed him after, insisting he keep a full change of clothes in one of my bedroom closets. His presentation caused my blood pressure to rise. Maybe if my property was a studio in a bad neighborhood, it would be OK for him to come show my place in shorts and a t-shirt. But, at least take a shower beforehand dammit!

* Doesn?t listen.?My realtor pushed me to do an open house multiple times. I told him NO each time, because all open houses do is open yourself up to nosy neighbors and potential robbery. I even sent him a report from the National Association of Realtors saying that only 2% of transactions ever come from open houses. I?ve personally been to over 100 open houses and I have never bought a thing!

I told him I cherish my privacy and to just use the internet marketing since 80% of buyers find their homes on the internet. He continued to push back, saying he wants the house to generate this ?frenzy factor?. I asked him why can?t he just host a private open house where each prospective buyer and agent is pre-screened to create a similar wow factor? I did that with my rental property and had 30 people come in a one hour window. He shrugged. Open houses are for the real estate agent to find new clients!

* False assumptions.?After saying I wouldn?t have to pay anything out of pocket, he sprung the $440 pest inspection fee I have to pay for the disclosure packet. I?m all for a thorough disclosure packet, however, if you know the amount of commission I?m paying, you will shit a brick at his audacity to back pedal. What was originally a ?no cost to you? listing, became a $440 pest inspection fee, a $1,000 paint job in the living and dining room, and who knows what else.

* Not in my corner.?My realtor is on a tennis league team which I was thinking of joining. I use the word ?was? because when I asked him whether I had a chance to play singles for his team, he told me that it would be hard because the singles players have been members for a long time already. In essence, he didn?t believe in me. He didn?t offer to talk to the captain to try and work me in. I don?t want a realtor who isn?t 100% in my corner. The messed up thing is I kicked his ass in tennis, and would beat his team?s singles players 80% of the time because I know who they are!

WHAT TO LOOK FOR IN A REALTOR

* How big is his or her network??The longer he?s been in the game, the larger his network. Realtors can work from anywhere, so they don?t necessarily have to be a 10 year veteran of one firm In fact, if they?ve moved every 3-5 years, that could be a good sign they are in high demand. There is a virtuous cycle on one?s reputation the longer they have been working.

* Does he have a web presence??If your realtor doesn?t have a hisname.com website in this day and age where 80% of properties are found on-line, then you should be a little leery. The website should have basic info such as his bio, his previous transactions, thoughts on the market, some pretty graphs, and so forth.

* Does he do what he says he?s going to do? If he says he will be at your house at 1pm, does he arrive at 12:45pm to prepare the house and gather his thoughts beforehand? When he says he will handle the upfront costs, does he pay for everything or try and get you to pay some of the bill?

* Does he have a reasonable level of intelligence??You must ask them questions about their thoughts on the markets and see if they can put together a coherent argument. Realtors get an extremely bad wrap for being dumb by just regurgitating what CNBC, or the National Association of Realtors write. The realtor should have his own opinions, and facts that buttress these opinions. With good intelligence, also comes good salesmanship, because the more you know, the more you are able to sell convincingly.

* Does he have strong integrity??The one thing I like about my realtor is that he has great integrity. I asked him whether I should disclose a minuscule leak in the ceiling that I fixed and he said, absolutely. I asked him whether I should turn on the portable air-filter in one room to help drown out some outside noise, and he said best to leave it off to be completely upfront. Good integrity goes a long way because it minimizes the risk of negative surprises.

* Does he make people feel comfortable??If you don?t feel comfortable being around your realtor, the buyers probably won?t feel comfortable either. The good thing about my realtor is that he leaves people alone to walk the property and doesn?t pepper them with questions. He lets people take their time and follow-up with him. I generally see this as a positive sales attribute, because I dislike pushy sales people.

* Can you feel his hustle??When you wake up in the morning, has he sent you some new thoughts and a marketing game plan? Has he created a Google Docs spreadsheet to track all the prospective buyers who have come through and shared the file with you? Has he suggested you go with him to make appointments to see the competitive properties on the market? ?You need to see and hear his hustle. You don?t want him strolling to your house in the nick of time in his shorts and t-shirt because he had a practice match beforehand!

THE OTHER AGENT IS INCREDIBLY IMPORTANT

The oligopoly priced 5% minimum commission fee is ridiculous for expensive cities such as San Francisco and New York. Why on earth does it cost $150,000 in commissions to sell a $3 million dollar house, for example? I can maybe understand a $10,000 commission on a $200,000 house, but it doesn?t take 15X more work to sell a $3 million dollar house.

Despite the price fixing, don?t underestimate the power of the 2.5% commission for the buyer?s agent. The 2.5% commission for the buyer?s agent is an incredible incentive that makes Realtors hustle to do whatever it takes to make the buyers happy, which hopefully leads to a smooth transaction.

Paying a 5% commission makes me sick, however, I do feel I?m getting better ?value? that the fee is split and incentivizing both parties to make something happen. Don?t feel their commissions are fixed, either. ?Both sides with definitely be willing to negotiate down their commissions if the choice is between walking away, and making a transaction happen.

THE INTERNET SAVES THE DAY

Even if you are stuck with a dud of a realtor, it is very hard to screw up a sale if you?ve priced your properly correctly and made the house look its best condition. With sites such as Trulia, Zillow, MLS, and the agent?s own network, it?s easier than ever before to sell your property.?The listing agent?s main responsibility is to get the word out and show the house. So long as the realtor isn?t an asshole or an idiot, the market will set the price.

You need to trust a realtor will do everything possible to get the word out and fight for your best interests. Good work experience, a web presence, and a great network should be standard. The problem with my guy is that I couldn?t stop thinking how my realtor wouldn?t speak up for me to join his tennis team. It?s that awkward moment where a friend speaks to you about another friend?s mutual party you weren?t invited to.

Finally, paying a 5% commission to sell a property just seems wrong. I?ve made a promise that I will never sell my house unless someone gives me a ridiculous price or until the commission level drops to a more reasonable 2-3%.

The Galaxy Note II for Sprint ($299.99 direct) is many things, but above all, it's the most?phone there is. It gives you more screen, more processor, and more OS than just about any other phone out there. It's also a significant improvement over the first Galaxy Note?, thanks to a faster quad-core processor and the Android 4.1 "Jelly Bean" OS, not to mention a host of Samsung-developed note-taking software improvements. If you think other phones are too small, and prefer something big enough to double as a miniature tablet that (barely) fits in your pocket, the Galaxy Note II reigns supreme. It's the first recipient of our new Editors' Choice award for phablets (phones with screen sizes ranging from 5.0 to 6.9 inches). That said, Sprint's lack of LTE coverage continues to be a problem.

Editors' Note: The Sprint, AT&T, and T-Mobile versions of the Samsung Galaxy Note II are all very similar, so we're sharing a lot of material between our reviews. That said, we're testing each device separately, so read the review for your carrier of choice. The slideshow below is for the T-Mobile version, which is visually identical aside from the carrier name in the notification bar, and the logo on the plastic back panel.

Design and Screen
Visually, there's almost no difference between the various versions, aside from a Samsung logo (not Sprint, oddly enough) on the back panel instead of a carrier name.?The Galaxy Note II measures 5.95 by 3.17 by 0.37 inches (HWD) and weighs 6.34 ounces. That's roughly an inch taller and half an inch wider than even big smartphones with 4.5-inch and greater screens. It's just as thin as those, though, which helps a lot. It's made entirely of plastic with the exception of the glass screen. But unlike some other Samsung handsets, the Galaxy Note II looks and feels refined, thanks to the classy, faux-anodized silver finish and a smoked chrome accent ring around the sides. You can get one in either gray or white.

The star of the show is the 5.5-inch, 1,280-by-720-pixel, Super AMOLED capacitive touch screen. The aspect ratio is 16:9 this time, instead of 16:10 like the first Galaxy Note, which had a slightly higher 1,280-by-800-pixel resolution. Either way, the new display is stunning. It's super-bright, with vivid colors and deep blacks, and viewing angles are uniformly excellent. I suppose you could argue that at 267ppi, pixel depth isn't quite as impressive as it is on smaller phones with the same 720p resolution. But rest assured: This screen looks fantastic.

As you can imagine, the screen is large enough for easy typing in both portrait and landscape modes. You even get an extra row of number keys, so you don't have to switch the keyboard mode to enter in digits.?There's a hardware Home button below the screen, flanked by Menu and Back capacitive touch buttons. A Wacom-designed stylus is tucked into a slot under the bottom right edge. The stylus supports 1,024 levels of pressure sensitivity?four times what the stylus in the Galaxy Note supports.

Given its gargantuan size, the Galaxy Note II is difficult to use one-handed?except that, fortunately, Samsung has already thought of this. To that end, it provides a series of toggles in Settings > One-Handed Operation.?You can move the dial buttons to the left or right, for example, and position the keyboard and unlock pattern for easier access.

Connectivity and Voice Calls
The Galaxy Note II on Sprint is a dual-band EV-DO Rev. A (850/1900 MHz) and 4G LTE device with 802.11a/b/g/n Wi-Fi support on both 2.4 and 5GHz bands. I had no problem connecting to a 5GHz, WPA2-encrypted hotspot in the PCMag Lab. We're rating the Sprint version of the Galaxy Note II down half a point compared with the other carrier models, thanks to the lack of Sprint LTE coverage in most U.S. major cities. Without LTE, the phone works as a 3G device, but Sprint's 3G network is the slowest of the major U.S. carriers; download speeds struggled to break just 200Kbps, which puts it closer to 2G than 3G, and many attempts at reaching the Internet timed out altogether in our midtown Manhattan test location.

Voice calls sounded as good as I've ever heard on a cell phone, and essentially matched what I heard with the T-Mobile version, at least through the earpiece; it sounded full, warm, and loud, with no background hiss. I could move my ear quite a bit against the handset and still hear the other party easily, which wasn't possible with the?LG Intuition. Transmissions through the microphone were clear, although a little thinner-sounding than on other carriers. I tested the phone on an extremely noisy street, which the noise cancelling algorithms reduced to a low, steady drone (which was entirely absent in quieter environments).

Calls also sounded clear through a?Jawbone Era?Bluetooth headset. Pairing was simple; tap the Bluetooth icon in the notification bar and the phone immediately looks for new Bluetooth devices. The rear-mounted mono speakerphone sounded clear and loud, and should be fine for use outdoors. We expect good things out of the oversize 3100mAh battery; we're still testing battery life and will update this review as soon as we have a result.

Voice dialing deserves special mention. Samsung's S Voice lets you control the Note by voice. You can wake it up by saying Hi Galaxy, double-tapping the Home button, or by choosing your own phrase. You can also enable or disable handwriting mode, which activates when you pull the pen from the device. In addition to voice dialing?which worked fine over Bluetooth in my tests?you can also text, search contacts, navigate, schedule something on your calendar, add a task, start a music playlist, and update Twitter, all with your voice.

Hardware, OS, and Apps
Under the hood is a 1.6GHz quad-core A9 Samsung Exynos processor and 2GB of RAM. Android fans can rejoice, as the Galaxy Note II is the first Sprint handset to ship with Android 4.1 "Jelly Bean" out of the box. Benchmark results were at the top of the class almost entirely across the board; combine Jelly Bean with a quad-core processor and you get one fast phone. The exception was some gaming frame rate tests, the results of which lagged next to the Qualcomm-powered LG Optimus G, the only other quad-core phone available in America right now. But three separate Optimus G review units overheated repeatedly in our tests, and automatically dialed back the screen brightness to cool down, whereas the Galaxy Note II stayed cool to the touch, no matter how hard I made it work.

Florida ethics panel confirms Rivera accusations

TALLAHASSEE, Fla. (AP) ? The Florida Ethics Commission on Wednesday found probable cause that Rep. David Rivera, who is in a tight re-election race, committed 11 violations of ethics laws while he was a state legislator.

Accusations against the Miami Republican include receiving income from Southwest Florida Enterprises Inc., a company involved with Flagler Dog Track in Miami, that he knew or should have known was given to influence his vote or official action and using campaign funds for non-campaign expenses.

Rivera also is alleged to have had a $1 million contract through Millennium Marketing, Inc., with Southwest Florida Enterprises that created a frequent conflict between his private interests and public duties. Millennium, a company founded by Rivera's mother, signed the 2006 contract to manage a successful campaign to expand slot machine gambling in Miami-Dade County through a referendum.

Rivera issued a statement vehemently denying wrongdoing and accusing the bipartisan commission of choosing "to play politics by injecting itself into the middle of an election" through previously investigated complaints filed by his political opponents.

"These allegations are false and will be dismissed shortly," Rivera said. "Respectfully, shame on the Florida Ethics Commission. I look forward once again to disproving these false allegations and demonstrating the frivolous nature of these complaints."

Ethical questions have lingered over Rivera since he was elected to Congress two years ago, and they have overshadowed his rematch with Democratic challenger Joe Garcia, a former Obama administration official in the Department of Energy.

Garcia's campaign issued a statement calling the charges "embarrassing to our entire community" and saying voters will have a chance on Nov. 6 to "turn the page on Mr. Rivera's scandals."

The congressman also remains under federal investigation for potential tax violations. A related Florida Department of Law Enforcement investigation cleared him of criminal allegations in April, but the Ethics Commission relied heavily on information gathered by the FDLE.

Rivera can seek a hearing to dispute the allegations or a settlement with the commission. The panel is powerless to penalize him, but the Florida House could take action based on its findings.

Rivera personally tried to get the ethics commission to delay its probable cause hearing, held behind closed doors on Friday, which would have pushed it past the election, according to records released Wednesday. His lawyers also pressed for a delay, saying it would be "extremely prejudicial" to have it decided so close to the election.

Rivera received payments from Millennium and voted for a 2007 bill that increased the number of slot machines allowed at pari-mutuel facilities, including 25 percent more for Flagler, according to a recommendation from the commission's advocate, Diane Guillemette, who works in the attorney general's office.

The commission found no probable cause of a voting conflict due to a five-year statute of limitations but cited the 2007 vote to support findings of unauthorized compensation and having conflicting employment or contractual relationships.

Records show Rivera was not interviewed for the case, but his lawyer, Richard Coates, submitted a lengthy letter to the commission in August that denied all allegations.

Coates characterized the payments Rivera received through Millennium as loans that he fully repaid, but Guillemette wrote that "a trier of fact could make a reasonable inference that they were in fact compensation which Respondent attempted to disguise as loans when his financial disclosures were questioned."

The commission also found probable cause for six alleged financial disclosure violations and that he misused his position to request state reimbursement for travel already paid for by has campaign account. Another finding was that he allegedly failed to report a debt.

Guillemette added that it was reasonable for Southwest Florida Enterprises to expect Rivera's vote for the bill because it was paying him "to further gaming in Miami-Dade County."

Rivera also filed a proposed state constitutional amendment, HJR 849, after the company stopped payments but didn't pursue it after Southwest Florida Enterprises made a $460,363 payment to Millennium.

"If HJR 849 was not based upon the will of his constituency, why would Respondent file it, other than to induce payment from SWFE?" Guillemette asked.

Southwest Florida Enterprises vice president Alex Havenick, whose family owns Flagler, signed the contract with Millennium, which at the time was being run by a friend of Rivera's mother. Coates denied Rivera received any money from gambling interests, again arguing the money he received from Millennium came in the form of loans.

"Second, any gaming legislation in which Mr. Rivera had a role was statewide in nature and did not affect, impact or benefit any specific or exclusive entity," Coates wrote.

He contended Rivera's campaign never reimbursed him for the travel for which he billed the state and that his financial disclosure filing were in compliance or amended to bring them into compliance.

Marissa Mayer Makes Her First Acquisition in ... - Business Insider

"Got to visit our new acquisition, Stamped, this morning - happy to be reunited with Robby (rmstein) and his team," Mayer posted on Instagram.

Update: Stamped has written a blog post about its acquisition. We've updated the article with information from the founders' post.

Stamped, a mobile app founded by two ex-Googlers, has been acquired by Yahoo.

It's Marissa Mayer's first acquisition (and one of Justin Bieber's first successful outcomes as a startup investor*), and it's no coincidence that Yahoo's CEO and Stamped share Google ties.

Stamped's CEO, Robby Stein, used to work for Mayer at Google where he was a product manager.

The buyout fits every hint Mayer has dropped about her acquisition plans:

  • She's bringing talent
  • She's bringing in mobile developers and engineers (Stamped has about 10 employees)
  • She's investing in a relatively cheap social startup that she and Yahoo can try and grow into a much bigger business.
  • The acquisition was in the right price range. While we don't know the exact amount, a source tells us it was "a nice size" but nothing wild.

Stamped launched one year ago as a mobile review app for places and things curated by friends.

This summer, the app was completely revamped, and Stamped brought on a list of all-star investors including Ryan Seacrest, Justin Bieber, Ellen DeGeneres and The New York Times. It has raised $3 million to date.

Although Stamped's app will be wound down, the acqui-hire is still a great win for New York tech. Mayer plans to use Stein's team to help build out something more robust for Yahoo on the east coast.?

"The Stamped team will be creating a brand new product and engineering office for Yahoo in NYC?s Bryant Park," the founders have written on their site. "After everything we learned from building Stamped, we?re excited to start work again on something big, mobile, and new -- but we can?t discuss the details just yet. And we?re really stoked to be able to hire lots of talented engineers and designers for this new project."

The acquisition is also a very Google-centered move on Mayer's part. Mayer is an ex-Googler; Stein's an ex-Googler. Google Ventures and Metamorphic Ventures (comprised of ex-Googlers) were two of Stamped's investors.

"As a team of mostly former Googlers, we?ve all worked with and are big fans of Marissa," the founders wrote.

"At the end of the day great teams win, we are excited to watch Robby and Bart help NYC and build out the next phase of Yahoo," Metamorphic's David Hirsch says.?
